CONDITIONS OF USE 

Welcome to our online store! Yonex South Africa and its associates provide their services to you subject to the following conditions. If you visit or shop within this website, you accept these conditions. Please read them carefully. 

When purchasing items from Yonex South Africa online, you agree to these terms and conditions.

• Invoices will be sent to you electronically.
• To purchase items online you will be required to register as an online shopper and will have to choose a username and password. Please keep this username and password safe and private. Yonex South Africa will not be held liable for any damage or losses you may incur from the unauthorized use of your profile. You will be asked for your username and password every time you shop online with Yonex South Africa.

PRODUCTS & PRICING:

• All items on our website are subject to availability. If the item that you ordered is not available, you will be notified as soon as possible.
• Prices displayed on our website are in South African Rands and are only valid and effective in South Africa. The prices are inclusive of VAT.
• We reserve the right to discontinue or change the specifications of our products without notice.
• Yonex South Africa has done everything possible to accurately display the products in colour, description, and price. Please note that the actual colour you see will depend on the device you use and we cannot warrant that your device’s display of any color will be exact. The prices displayed are subject to E&OE and may change based on rate fluctuations.
• Products on promotion may be subject to certain conditions such as stock availability and limited offer terms.

CANCELLATIONS:

• If necessary, you are able to cancel an order before it has been dispatched for delivery.
• If you need to cancel an order and the items have already been dispatched for delivery you will be held liable for the delivery costs.
• Refunds for cancellations will only be done once all items are returned to Aurora Sports if they have been dispatched.
• If a cancellation gets initiated by us, you won’t be liable for any cancellation fees.

RISK OF LOSS

All items purchased from Yonex South Africa are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Yonex South Africa and its associates attempt to be as accurate as possible. However, Yonex South Africa does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Yonex South Africa itself is not as described, your sole remedy is to return it in an unused condition.

DISPUTES

Any dispute relating in any way to your visit to Yonex South Africa or to products you purchase through Yonex South Africa shall be submitted to confidential arbitration in South Africa,  except that, to the extent you have in any manner violated or threatened to violate Yonex South Africa intellectual property rights, Yonex South Africa may seek injunctive or other appropriate relief in any state or federal court in South Africa, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
